General Terms and Conditions
The present general terms and conditions of sale (hereinafter referred to as the " General Terms and Conditions of Sale ") apply, without any restriction or reservation, to all sales of the Company LIGHTINUP SRL registered with the Companies' Register of PADOVA under the number 05419600282, having its registered office in PADOVA Via Palestro 1B (hereinafter referred to as " LIGHTINUP "), to purchasers, both final consumers and wholesale companies (hereinafter referred to as " Customer "), who wish to purchase products (hereinafter referred to as " Products ") marketed on the website www.bulby.it, in our retail shops, showrooms, or other distance selling methods

1. Subject matter of the General Terms and Conditions of Sale
The General Terms and Conditions of Sale mainly concern the nature of the order, the payment of the sales price, the associated guarantees and the delivery of the Product(s), with the exception of installation, which is not part of the services provided by the Company. Prior to purchasing one or more Products on the Site, the Customer is required to read and accept the General Terms and Conditions of Sale.
La Società si riserva il diritto di modificare le Condizioni Generali di Vendita di sua iniziativa o in seguito a variazione della normativa applicabile. In caso di modifica, alla vendita del Prodotto(i) si applicherà la versione disponibile sul Sito al momento dell’ordine emesso dal Cliente. La modifica delle Condizioni Generali di Vendita non avrà in nessun caso effetto retroattivo e avrà validità solo per gli ordini del Prodotto(i) trasmessi a partire dalla data di entrata in vigore.
2. Acceptance
The Customer accepts these terms and conditions electronically upon payment of the total amount or of the first agreed down payment or formalised by electronic payment or bank transfer of the amount due or part thereof by down payment.
The Customer also expressly waives its own terms, and local jurisdiction, even if these are introduced or enforced after acceptance of these General Terms and Conditions.
3. Product Features
The technical description of the Products has contractual value. However, it is hereby made clear that photographs of the Products may not fully and faithfully reflect all the characteristics of the Products and in particular their colour and consistency, insofar as colour depends on the characteristics and settings of the Customer's computer equipment and consistency may not be perfectly perceptible on the screen.
It is the customer's duty to ensure that the product has not undergone any technical modifications in order to improve its functionality and durability. Any modifications after the order, only in the electronic components (Light Sources, Drivers, Lampholders) that do not change in any way the final appearance of the product shall not be considered as imperfections but as improvements for regulatory and functional adaptation.
4. Product Order
The Customer wishing to purchase one or more Products must first of all :
· become acquainted with the characteristics of the Product(s)
· identify themselves on the Site or register by providing the Company with their details and delivery address;
· validate their order and the delivery deadline defined by the Company by confirming acceptance ;
· acknowledge and accept without reservation the General Terms and Conditions of Sale
5. Payment and ancillary services
100% upon order by bank transfer, Paypal and Stripe (Cards, Bank Transfer, Installment Schemes)
6. Right of Withdrawal, Delivery of Products and Liability
Products in stock ready for dispatch in 72 hours.
Shipping by express courier 2/3 days for Italy/EU and 5/7 days for non-EU countries - The cost of shipping by courier will be processed when the order is placed in the shopping cart.
For quantities or products that exceed the dimensions accepted by couriers and therefore require shipment by a qualified forwarding agent, the cost will be communicated to the customer at the time of goods readiness.
You may withdraw from the order within a period of 30 (thirty) days from the conclusion of the order or decide to replace the purchased product with others of equal value or modify the same product with different characteristics.
7. Payment Times
Our invoices are payable within a maximum of 21 days, unless another payment term is indicated on the invoice or order. In case of non-payment by the due date, LIGHTINUP reserves the right to demand payment of a fixed interest of 10% of the amount due.
The order will be initiated upon crediting of the payment by the customer in our systems. LIGHTINUP shall be entitled to suspend any sale of goods and services without notice in the event of late payment.;
If a payment is still outstanding more than sixty (60) days after the due date, LIGHTINUP reserves the right to use the services of a debt collection company. All legal costs shall be borne by the customer.
8. Warranty
LIGHTINUP offers the possibility of replacing or completely repairing products for damages attributable to the company - It also offers the possibility of guaranteeing decorative elements and product parts with a 2 (two) year cover.
9. Applicable Fees
Some countries apply a withholding tax on the number of invoices according to their national legislation. Any withholding tax will be paid by the customer to the Internal Revenue Service. Under no circumstances can LIGHTINUP be involved in costs related to the legislation of a country. The invoice amount will therefore be due to LIGHTINUP in its entirety and does not include any costs related to the legislation of the country where the customer is located;
10. Rights of Third Parties
LIGHTINUP shall under no circumstances be obliged by the customer to appear as a third party in the context of any claim brought against the customer by one of its end-consumers, intermediaries, or other parties related to the order.
11. Complaints
Affinché sia ricevibile, LIGHTINUP deve essere informata di ogni reclamo o contestazione - mediante lettera inviata a mezzo lettera raccomandata o a mezzo posta elettronica certificata - entro 8 giorni da: consegna della merce, prestazione dei servizi, comunicazione di modifica delle condizioni contrattuali.
12. Competent Jurisdiction
The customer expressly accepts that all our contractual relations shall be governed exclusively by Italian law. The competent court of jurisdiction is the Court of Padua
13. Personal Data
The Customer has the right to access, modify and delete data concerning him/her. This right may be exercised by simple written request by e-mail. Please refer to the privacy policy and third-party cookies posted on this site.
14. Dispute settlement for final consumers (B2C)
The customer has the right to have recourse, free of charge, to a consumer mediator for the purpose of settling amicably the dispute between him/her and the Company.
Please note that a dispute cannot be examined by the Consumer Ombudsman if :
· The Customer does not prove that it has previously attempted to settle the dispute directly with the Company by means of a written complaint in the manner provided for, where applicable, in the contract ;
· The request is manifestly unfounded or abusive ;
· The dispute has been previously examined or is still being examined by another mediator or court ;
· The client submitted his request to the mediator within a period of more than one year from the written complaint to the company.
