1. Subject matter of the General Terms and Conditions of Sale
The General Terms and Conditions of Sale mainly concern the nature of the order, the payment of the sales price, the associated guarantees and the delivery of the Product(s), with the exception of installation which is not part of the services performed by the Company. Before purchasing one or more Products on the Site, the Customer is required to read and accept the General Terms and Conditions of Sale.
The Company reserves the right to modify the General Conditions of Sale on its own initiative or following changes to applicable legislation. In the event of modification, the sale of the Product(s) shall be governed by the version available on the Website at the time the order is placed by the Customer. Any modification to the General Conditions of Sale shall in no event have retroactive effect and shall apply only to Product(s) orders placed from the date of entry into force, the current conditions are updated as of 17.10.2026
2. Acceptance
The Customer accepts these terms electronically at the time of payment of the total amount or the first agreed deposit, or alternatively formalised by electronic payment or bank transfer of the amount due or part of it by means of deposits.
The Customer also expressly waives their own terms and local jurisdiction, even if these were introduced or asserted after the acceptance of these General Conditions of Sale.
3. Product Features
The technical description of the products is contractually binding. However, it is specified herein, with regard to Product photographs, that these cannot comprehensively and faithfully reflect all Product characteristics, in particular color and texture, inasmuch as color depends on the characteristics and settings of the Customer's hardware and texture cannot be perfectly perceived on screen.
It is the customer's responsibility to ensure that the product has not undergone technical modifications aimed at improving its functionality and durability; any modification subsequent to the order, concerning solely the electronic components (Sorgenti Luminose, Drivers, Portalampada) that does not in any way change the final appearance of the product, shall not be considered an imperfection but rather an improvement for regulatory and functional compliance.
4. Product Order
The Customer wishing to purchase one or more Products must first of all:
· read the characteristics of the Product or Products and, for compositions, choose the components and the cable length in the configurator;
· identify themselves on the Website or register by providing the Company with their details and delivery address;
· validate their order and the delivery deadline set by the Company by confirming acceptance thereof;
· read and accept without reservation the General Terms and Conditions of Sale
5. Payment and order confirmation
100% on order with the payment methods offered at checkout (cards and other methods via Mollie, bank transfer).
Partial payments are not accepted unless expressly approved by the company's administrative body.
Partial payment will be considered as incomplete pending the balance and the relevant order will not be put into production until receipt of the balance corresponding to 100% of the deposit upon order.
6. Preparation, shipping, withdrawal and refund
Preparation:
Catalogue products are prepared for shipping within the times shown on each product page and in the order confirmation. Lamps composed with the configurator are assembled by us at the Customer's request: the assembly time is added to the preparation time and is shown in the summary of the composition.
Shipping:
Express courier shipping is free throughout the European Union on orders of €75 or more; for orders below €75 the cost is €14.90 including VAT. Delivery usually takes 2/3 working days from dispatch. Bulby ships only to countries of the European Union.
**In the event of returns managed by LIGHTINUP one of our original delivery couriers among those we work with, namely DHL, GLS, BRT/DPD, must be used exclusively, communicating our correct customer code. Any possible delivery by other forwarders who request payment upon delivery from LIGHTINUP, not included among these, will not be accepted and the goods will be refused.
Right of withdrawal for catalogue products:
The consumer Customer may withdraw from the purchase of catalogue products within 30 (thirty) days of delivery, without giving any reason, by notifying us as set out in point 11. The products must be returned undamaged, in their packaging, within 14 days of the notice of withdrawal.
Refund:
The amount paid, including the initial delivery costs, is refunded using the same means of payment used for the order within 14 days of receipt of the notice of withdrawal; LIGHTINUP may withhold the refund until it has received the returned products. If the Customer prefers, they may ask for a gift voucher with no expiry date instead of the refund.
Compositions assembled on request:
Lamps composed by the Customer with the configurator and assembled at their request are personalised goods and, as provided for by art. 59 of the Italian Consumer Code, are excluded from the right of withdrawal. They remain covered by the legal guarantee of conformity described in point 8. Individual components bought without assembly remain catalogue products.
7. Payment Terms
Our invoices are payable within a maximum of 21 days, unless another payment term is indicated on the invoice or on the order. In the event of non-payment by the due date, LIGHTINUP reserves the right to request the payment of a fixed interest equal to 10% of the amount due.
The order will be processed upon receipt of payment by the customer in our systems. LIGHTINUP shall be entitled to suspend any sale of goods and services without prior notice in the event of delayed payments;
If a payment is still pending after more than sixty (60) days from the due date, LIGHTINUP reserves the right to use the services of a debt collection agency. All legal fees will be borne by the customer
8. Guarantee
Consumers benefit from the legal guarantee of conformity of 2 (two) years from delivery provided for by the Italian Consumer Code: in the event of a defect LIGHTINUP repairs or replaces the product at no cost to the Customer and, where this is not possible, reduces the price or terminates the contract.
9. Applicable Taxes
Some countries apply a withholding tax on the number of invoices according to their national legislation. Any withholding tax shall be paid by the customer to the relevant tax authority. Under no circumstances can LIGHTINUP be involved in costs relating to the legislation of a country. The invoice amount shall therefore be due to LIGHTINUP in its entirety and does not include any costs relating to the legislation of the country where the customer is located;
10. Rights of Third Parties
LIGHTINUP shall under no circumstances be obliged by the customer to appear as a third party in the context of any claim for compensation brought against the customer by their end consumer, intermediary or any other party related to the order.
11. Requests for Withdrawal, Refunds and Complaints
Notices of withdrawal, refund requests and complaints are sent from the Support page of the site or by writing to hello@bulby.it, stating the order number. For withdrawal, an explicit statement of the decision to withdraw is enough; registered letter with return receipt or certified email may also be used.
The Customer is asked to check the products on delivery and to report any damage caused in transit within 8 days, so that a claim can be opened with the courier. Defects of conformity remain covered by the 2-year legal guarantee in point 8.
12. Competent Jurisdiction
Contractual relationships are governed by Italian law. Jurisdiction lies with the court of the place where the consumer resides or is domiciled (Article 66-bis of the Italian Consumer Code), notwithstanding any other provision of these terms.
13. Personal Data
The Customer has the right to access, modify and delete their personal data. This right may be exercised with a simple written request by email. Please refer to the privacy and third-party cookie policy published on this website.
14. Consumer Dispute Resolution (B2C)
The Customer has the right to resort free of charge to a consumer mediator in order to amicably resolve the dispute with the Company.
Please note that a dispute cannot be examined by the consumer mediator if:
· The Customer fails to prove that they have previously attempted to resolve the dispute directly with the Company by means of a written complaint in accordance with the procedures provided for, where applicable, in the contract;
· The request is manifestly unfounded or abusive;
· The dispute has been previously examined or is still being examined by another mediator or a court;
· The Customer has submitted their request to the mediator after a period of more than one year from the written complaint sent to the Company.
